THESE TERMS INCLUDE AN ARBITRATION CLAUSE FOR USERS IN THE UNITED STATES AND CANADA. IF YOU ARE LOCATED IN THESE REGIONS, YOU AGREE THAT DISPUTES BETWEEN YOU AND SOL INDEX WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION, AND YOU WAIVE YOUR RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION OR OTHER REPRESENTATIVE PROCEEDING.

2. SERVICES PROVIDED

Sol Index is a platform that simplifies the investment process of Solana-based tokens by providing users with streamlined access to diversified exposure. We allow users to purchase tokens and present information in an aggregate format for their convenience and ease of use. The Service and the Platform are provided solely for educational purposes and are not intended to include or represent financial advice or indicate any trading opportunity. Due to factors beyond the Company's control, the Company does not warrant the accuracy, completeness, or utility of any information on the Platform or in the Services at any particular time. Any reliance users place on such information is strictly at their own risk. The Company disclaims all liability and responsibility arising from any reliance placed on such content by users or any other visitor to our Website, or by anyone who may receive its contents. Any information users provide or the Company collects through the Website shall be handled in accordance with the Website’s Privacy Policy.

3. ELIGIBILITY

A 1% fee is charged on all transactions conducted through our platform. You agree to pay all fees and charges associated with your use. Sol Index reserves the right to change its fees and charges at any time, upon notice to you if such changes affect your existing use of the Services.

13. RISK ACKNOWLEDGEMENT

13.1 BLOCKCHAIN AND SMART CONTRACTS

You acknowledge that Sol Index interacts with public blockchains and smart contracts, which may involve risks including but not limited to technical errors, security breaches, and unforeseen vulnerabilities. Sol Index is not responsible for any losses resulting from such risks.

13.2 DIGITAL ASSET VALUATION

The prices of digital assets are highly volatile and may be impacted by various factors including market demand, regulatory developments, and technological advancements. Sol Index makes no representations regarding the value of any digital assets available through the platform.

14. ARBITRATION AND DISPUTE RESOLUTION

14.1 ARBITRATION AGREEMENT

All disputes arising out of or in connection with these Terms shall be resolved through binding arbitration on an individual basis. The arbitration will be conducted in Delaware and will be governed by the laws of the State of Delaware.

14.2 WAIVER OF JURY TRIAL AND CLASS ACTIONS

You waive your rights to a jury trial and agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

14.3 30-DAY RIGHT TO OPT OUT

You have the right to opt out of the arbitration agreement by sending a written notice to the administrators of the Sol Index Telegram group within 30 days of first agreeing to these Terms.

15. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought in the relevant courts of Delaware.

16. FEEDBACK

We welcome feedback, comments, ideas, and suggestions for improvements to the Site and the Services (“Feedback”). You grant us a non-exclusive, worldwide, perpetual, irrevocable, fully-paid, royalty-free, sublicensable and transferable license under any and all intellectual property rights that you own or control to use, copy, modify, create derivative works based upon or improvements with respect to, and otherwise exploit and commercialize the Feedback and any such derivative works and improvements in any manner and for any purpose.

17. PRIVATE BETA PROGRAM NOTICE

Sol Index Services may be in Beta testing. Your participation in the Private Beta Program is personal and not transferable. You are only entitled to access and use the Services for lawful purposes and understand that the Beta Program is provided on an “AS-IS” and “AS-AVAILABLE” basis for the purpose of testing and providing feedback.
